1. Acceptance and eligibility
These Terms of Use form an agreement between you and Ascention, the operator of Dressyuh. By accessing or using dressyuh.com, the sample experience, or the Dressyuh Shopify service, you agree to these terms and our Privacy Policy. If you do not agree, do not use Dressyuh.
You must be legally able to enter this agreement. If you use Dressyuh for a company or other organization, you confirm that you have authority to bind that organization to these terms. Additional terms shown by Shopify or a participating retailer may also apply.
2. The Dressyuh service
Dressyuh provides virtual fitting technology that helps shoppers visualize selected clothing on a submitted photo. Participating merchants can add the experience to eligible Shopify product pages and receive operational and performance information about the feature.
The interactive experience on dressyuh.com is a sample built with preselected images. It does not upload a visitor photo or generate a live try-on. Labels, prices, products, calculations, and projected outcomes in the sample are illustrative unless clearly stated otherwise.
3. Virtual preview limits
A Dressyuh result is an AI-generated visual preview. It may contain errors, artifacts, or differences in fit, proportion, drape, color, texture, length, coverage, product detail, or body appearance. It is not a measurement tool, size recommendation, tailoring opinion, medical opinion, or guarantee that a garment will look or fit the same way in person.
Shoppers should review the retailer's official product images, description, materials, measurements, size guide, price, availability, and return policy before purchasing. Merchants must not present a generated preview as a factual or guaranteed representation.
Research findings and external benchmarks shown on Dressyuh pages describe broader category opportunities. They do not promise a specific merchant, conversion, revenue, satisfaction, or return-rate result.
4. Photos and other content
You keep your rights in the photos and other content you submit. You give Dressyuh and its processing providers a limited, nonexclusive permission to process that content only as needed to provide, secure, troubleshoot, and support the requested service, subject to our Privacy Policy and provider agreements.
You may submit content only when:
- you own it or have valid permission to use and process it;
- every identifiable person shown has authorized the use;
- you have the required parent or guardian authority for a minor;
- the content does not violate privacy, publicity, intellectual property, or other legal rights; and
- the content is not unlawful, exploitative, sexually explicit, threatening, deceptive, or intended to impersonate or harm another person.
We may reject, block, or stop processing content that appears to violate these terms or create a safety, legal, or security risk.
5. Merchant responsibilities
A merchant using the Dressyuh Shopify app is responsible for:
- having authority to install and configure the app for its store;
- providing accurate product images and information that it has the right to use;
- giving shoppers legally sufficient notices and collecting any consent required for photo processing;
- maintaining its own privacy policy, terms, accessibility practices, and consumer disclosures;
- following applicable advertising, privacy, biometric, consumer-protection, and children's privacy laws;
- honoring product, fulfillment, refund, return, tax, and customer-service obligations; and
- reviewing Dressyuh reporting before relying on it for business decisions.
Merchants must not use Dressyuh for identity recognition, authentication, surveillance, eligibility decisions, employment, credit, insurance, housing, health decisions, or another high-impact purpose.
6. Shopping and purchases
The participating retailer, not Dressyuh, is the seller of the clothing shown in a store. The retailer controls product descriptions, prices, inventory, checkout, payment, taxes, shipping, delivery, cancellations, returns, refunds, warranties, and customer support. Dressyuh is not a party to the garment purchase between a shopper and retailer.
Questions or disputes about a product or order should be directed to the retailer. Nothing in these terms limits a shopper's mandatory consumer rights under applicable law.
7. Shopify app plans and fees
Merchant plans, included usage, overages, billing intervals, trial terms, and other charges are shown through the Dressyuh app or Shopify before the merchant approves them. Shopify may process those charges. A merchant remains responsible for approved charges until it cancels according to the displayed plan and Shopify's billing rules.
We may change plans or pricing prospectively. We will provide notice when required and will not retroactively change a charge already approved for a completed billing period.
8. Acceptable use
You must not:
- use Dressyuh unlawfully or in violation of another person's rights;
- bypass consent, access, rate, generation, billing, or security controls;
- probe, scan, disrupt, overload, or introduce malicious code into the service;
- scrape, copy, resell, sublicense, or commercially exploit the service except as expressly permitted;
- reverse engineer or attempt to extract models, source code, or nonpublic system components except where law prohibits this restriction;
- use automated means to generate abusive traffic or exhaust service credits;
- misrepresent AI-generated output as an actual photograph or guaranteed product result; or
- help another person do any of the above.
9. Third-party services
Dressyuh relies on services provided by Shopify, participating retailers, FASHN LTD, hosting providers, and other infrastructure partners. Their terms and privacy practices may apply to their part of the experience. We are not responsible for a third party's store, product, checkout, content, policy, outage, or independent conduct.
Links to third-party websites are provided for convenience and do not imply that Dressyuh controls or endorses everything on those sites.
10. Dressyuh ownership and feedback
Ascention and its licensors own Dressyuh, including its software, interface, design, branding, documentation, and related intellectual property, except for merchant, shopper, and third-party content. These terms give you a limited, revocable, nontransferable right to use the service as intended. They do not transfer ownership.
If you send ideas or feedback, you allow us to use them without restriction or compensation. We will not treat feedback as confidential unless we agree otherwise in writing.
11. Availability, changes, and termination
We may update, suspend, limit, or discontinue part of Dressyuh for maintenance, security, legal, provider, or product reasons. We do not guarantee uninterrupted availability, a particular generation speed, or compatibility with every photo, garment, theme, browser, device, or Shopify configuration.
We may suspend or terminate access when we reasonably believe a user violated these terms, failed to pay approved charges, created risk for the service or another person, or when required by law. A merchant may stop future use by uninstalling the app and following the applicable Shopify billing process. Sections that should logically continue, including ownership, disclaimers, liability, and governing law, survive termination.
12. Disclaimers
To the fullest extent permitted by law, Dressyuh is provided "as is" and "as available." Ascention disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, and uninterrupted or error-free operation. We do not warrant that a generated preview will be accurate, that a garment will fit, or that use will produce a business or shopping outcome.
Some jurisdictions do not allow certain warranty exclusions. In that case, an exclusion applies only to the extent allowed by law.
13. Limitation of liability
To the fullest extent permitted by law, Ascention and its affiliates, officers, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising from Dressyuh or these terms.
To the fullest extent permitted by law, their total liability for all claims relating to Dressyuh will not exceed the greater of $100 or the amount you paid directly for Dressyuh during the 12 months before the event giving rise to the claim. This limit does not apply where a limitation is prohibited, including liability that cannot legally be excluded or limited.
If you use Dressyuh for a business, you will defend and indemnify Ascention from third-party claims, damages, and reasonable costs caused by your content, store, products, violation of these terms, or violation of law or another person's rights.
14. Governing law and general terms
New York law governs these terms without regard to conflict-of-law rules. Unless applicable law requires another forum, the state and federal courts located in New York County, New York will have exclusive jurisdiction over a dispute relating to these terms or Dressyuh.
These terms and the Privacy Policy are the entire agreement about the public website and service unless a separate written merchant agreement applies. If one provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms without our consent. We may assign them as part of a reorganization, financing, merger, sale, or transfer of the service.
15. Changes and contact
We may update these terms as Dressyuh changes. We will post the revised terms here and update the effective date. Material changes apply prospectively after any notice required by law. Continued use after the revised terms take effect means you accept them.
